About these terms
This website, logisticsfinearts.com, is operated by Logistics Fine Arts, Miami, Florida, together with our departments Espace Expression and Fine Arts Affairs ("LFA", "we", "us", "our"). These Terms of Use apply to everyone who visits the site, registers an account, asks for prices or purchases a work through it. By using the site you agree to them. If you do not agree, please do not use the site.
Use of the site
You may browse the site and share links to it for personal, non-commercial purposes. You agree not to:
- copy, download in bulk, scrape or republish images, texts or catalogue data from the site;
- use the site to send unsolicited messages, or for any unlawful purpose;
- try to access accounts, areas or data that are not yours, or interfere with the security or operation of the site.
Images and intellectual property
The works shown on this site are protected by copyright. Images of artworks are reproduced for information and are © the artists, their estates or their representatives; photographs, texts, logos and the design of the site are © Logistics Fine Arts unless stated otherwise. Nothing on the site grants you a licence to reproduce them. For permissions, press or educational use, please write to us.
Information about works
We take great care in describing each work (artist, title, date, medium, dimensions, edition). Even so, colours on a screen differ from the actual object, and descriptions may contain errors. Please ask us for a condition report, additional photographs or documentation before purchasing; the information we confirm to you in writing prevails over what is shown on the site.
Accounts
To receive prices you need to register an account with accurate information. You are responsible for keeping your password confidential and for activity under your account. We may suspend or close an account that is used in breach of these terms. You may ask us to close your account at any time.
Price requests and personal viewing rooms
The showcase on this site does not display prices. When you select works and send a price request, we may reply with a viewing room prepared for you, with the prices and conditions we offer you personally.
- Prices in your viewing room are personal and confidential, in US dollars and exclusive of sales tax, crating, transport and insurance.
- They are valid until the date shown in the viewing room or, if no date is shown, until we close the viewing room or the work is sold.
- All works are offered subject to prior sale. A work is only reserved for you once payment is completed, or when we confirm a reservation in writing.
- We may correct an obvious error in a price or description; if this affects a purchase you have already made, we will contact you and you may cancel it with a full refund.
Purchases and payment
Purchases are completed through the secure checkout of our payment provider, Square. We do not receive or store your full card details. Florida sales tax is added at checkout where it applies. Your purchase is confirmed when the payment is approved; you will receive a receipt from Square and a confirmation from us.
While a checkout is open, the works in it are held for 30 minutes. If the payment is not completed, they become available again.
Delivery, crating and transport
Works are delivered at our premises in Miami, Florida. The buyer hires and pays the carrier of their choice, who collects the work from us on a date agreed with us; on request, we can suggest specialized fine-art carriers.
If the work needs to be crated, we can crate it in our atelier; crating is quoted separately and is not included in the price.
From the moment the work is handed over to the buyer's carrier, transport, insurance and any damage or loss in transit are at the buyer's charge and risk. Import duties and taxes in the country of destination are also the responsibility of the buyer.
Sales are final
All sales are final. Except for the case of an obvious error on our part described above, once a work has been paid for, the purchase cannot be cancelled, and works cannot be returned or exchanged. Before you buy, please ask us for any condition report, photograph or document you need: we will gladly provide them.
Transport is at the buyer's charge and risk, as explained in “Delivery, crating and transport”.
Links and third-party services
The site links to or embeds services run by others, such as Instagram, Kunstmatrix (3D online exhibitions), Google Fonts and Square. Their own terms and privacy policies apply to them, and we are not responsible for their content or availability.
Liability
We provide the site "as is" and cannot guarantee that it will always be available or free of errors. To the extent permitted by law, LFA is not liable for indirect or consequential losses arising from the use of the site. Nothing in these terms limits any liability that cannot be limited by law, or your statutory rights as a consumer.
Changes
We may update these terms from time to time. The version published on this page, with its date, applies from the moment it is published. Purchases are governed by the terms in force on the date of the purchase.
Governing law
These terms are governed by the laws of the State of Florida and the applicable federal laws of the United States. Any dispute will be submitted to the courts located in Miami-Dade County, Florida, unless the law of your place of residence gives you a different right.
